Our Service is intended to be used by parents or guardians and their children. We recognize that from time to time we may have children under 13 use the site under the supervision of a parent. When that happens, we take additional precautions to protect the privacy of children under 13. The Children's Online Privacy Protection Act ("COPPA") requires that we inform parents and legal guardians about how we collect, use, and disclose personal information from children under 13 and that we obtain the consent of parents and guardians in order for children under 13 to use certain features of our Site. This Kid's Privacy Policy is designed to give parents information in addition to that provided in our general Privacy Policy.
When a user creates a CompetitionSuite account, we ask for username, first name, email address, password and a birth date. If we determine the child is under 13 (a "kid"), we will ask for a parent's name and email address so that we can notify the parent that the kid has created an account at CompetitionSuite and seek the parent's consent to allow the kid's participation. If the parent provides consent, we may collect additional information from the kid, including a profile avatar, which could include a photograph. The information we collect from kids may be directly linked to their actions on the Service, such as their self-reported competition scores or when they send us a message.
Important Information for Parents: CompetitionSuite uses artificial intelligence ("AI") and automated technologies to provide certain features of the Service. This section explains how these technologies may process information related to kids under 13.
How AI May Process Kids' Information
When a kid participates in competitions through the Service, judges and evaluators may record audio or video commentary about the kid's performance. This commentary may be processed using AI technologies in the following ways:
- (a) Transcription of audio commentary into written text to make feedback more accessible;
- (b) Summarization of judge feedback to highlight key points and themes;
- (c) Analysis of commentary to identify patterns and actionable insights for improvement;
- (d) Conversational interfaces ("chatbots") that allow authorized users to ask questions about commentary feedback.
Third-Party AI Service Providers
We use third-party AI service providers, including Anthropic (provider of Claude AI), to power these features. When AI features are used in connection with a kid's performance data, the relevant commentary content may be transmitted to these providers for processing. We require our AI service providers to: (i) use the data only to provide services to CompetitionSuite; (ii) not use kid data to train their general AI models; (iii) maintain appropriate security measures; and (iv) delete data after processing is complete or within the retention period specified in our agreements.
Parental Consent for AI Processing
AI processing of information related to kids under 13 is included within the scope of the verifiable parental consent we obtain when a parent registers and approves their kid's participation in the Service. By providing verifiable parental consent for your kid to use the Service, you consent to the processing of performance-related information (including judge commentary about your kid) using AI technologies as described in this section and in our general Privacy Policy.
Opting Out of AI Processing
Parents may opt out of AI processing of their kid's performance-related information by contacting us at [email protected]. Please note that opting out may limit access to certain features of the Service that rely on AI processing, such as automated transcription of commentary, AI-generated summaries, and chatbot interfaces. Opting out of AI processing will not affect your kid's ability to participate in competitions or receive scores and traditional (non-AI-processed) feedback.
AI Output Limitations
Parents should be aware that AI-generated transcriptions, summaries, and analyses may contain errors or inaccuracies. AI outputs are provided as supplementary tools to help understand judge feedback and are not a substitute for official scores or rankings. We encourage parents to review AI-generated content with their kids and contact us if they have concerns about accuracy.
We use this information to operate, maintain and provide the functionality of the Service and to communicate with the kid and the parent about activities on the Service. We may also send Service-related emails (e.g., account verification, changes or updates to features of the Service, technical and security notices). Registered users cannot opt-out of Service related emails. When a kid under 13 creates a CompetitionSuite account, we use the parent's email address to notify the parent of the kid's registration (see "How we notify parents of the data collection" below).
Disclosing competition-related information, such as participant names and scores, is integral to the Service. Your child's use of the Service may involve disclosure of certain personal information to judges, other competitors, and possibly the public internet.
Our Service generally permits users to connect with others on the Service and to share information with others. Members under 13 have restricted sharing capabilities, though a kid under 13 may be permitted to share information in the following manner:
- Kids will share information automatically with a parent on the Service.
- Kids under 13 are not permitted to share their information publicly on the Service.
In addition, we may share a kid's personal information with:
- Affiliated Companies. Other companies owned by or under common ownership as CompetitionSuite, which includes our subsidiaries (i.e., any organization we own or control) or our ultimate holding company (i.e., any organization that owns or controls us) and any subsidiaries it owns. These companies will use the personal information in the same way as we can under this Policy;
- Service Providers. Third party vendors, consultants, contractors and other service providers that perform services on our behalf, in order to carry out their work for us, which may include content or service fulfillment, accounting, or providing analytics services;
- AI Service Providers. Third-party artificial intelligence service providers, including Anthropic (provider of Claude AI), who process performance-related information (such as judge commentary transcriptions) to provide features such as summarization, analysis, and conversational interfaces, subject to the protections described in the "Artificial Intelligence and Automated Processing" section above;
- Legal Requirements. Third parties as reasonably necessary to (i) satisfy any applicable law, regulation, subpoena/court order, legal process or other governmental request, (ii) enforce our Terms of Use Agreement, including the investigation of potential violations thereof, (iii) investigate and defend ourselves against any third party claims or allegations, and (iv) exercise or protect the rights, property, or personal safety of CompetitionSuite, our Users or others.
We may also share information with others in an aggregated and anonymous form that does not reasonably identify any user, including our kid users, directly as an individual.
We do not permit interest based advertising on our site.
We send parents an email when their kid creates an account at CompetitionSuite and ask the parent to register with the Service and provide consent for the kid to use the Service. If the parent refuses to allow the kid's registration, we delete the kid's information from our databases. The kid will not be permitted to engage in the core functionality of the Service unless and until we receive verifiable parental consent to engage in such activity.
The parent may provide verifiable parental consent by supplying a credit card or debit card in association with a payment to the Service of a nominal parent verification fee. At that time, the kid will be able to participate in the Service as permitted by the parental controls set in the Parent Dashboard.
The parental consent notification will include information about AI processing of performance-related data as described in this Policy. Parents who have questions about AI processing or wish to opt out may contact us at [email protected] before or after providing consent.
A registered user can modify personal data or delete a CompetitionSuite account at any time by visiting the "Settings" page. A parent user that has provided verifiable parental consent has full access to the kid's account through the Parent Dashboard, and may view, modify, and consent to the collection and use of the kid's personal information.
A parent or child may contact us at any time by emailing us or by contacting us at the address below to:
- Review, change, and/or delete any information we have collected from a kid under 13;
- Disallow any further collection or use of the child's information;
- Opt out of AI processing of the child's performance-related information;
- Request deletion of any AI-generated content (such as transcriptions or summaries) related to the child.
We retain information collected from kids for as long as the account is active or as needed to provide the Service. If a parent requests deletion of their kid's account or information, we will delete the information within a reasonable timeframe, except as required to comply with legal obligations or resolve disputes. AI-generated content (such as transcriptions and summaries) related to a kid will be deleted upon request or when the underlying account data is deleted.
We use commercially reasonable physical, administrative, and technological safeguards to protect kids' personal information. We require our service providers, including AI service providers, to maintain appropriate security measures. However, no security system is impenetrable, and we cannot guarantee the absolute security of information.
